Version 1.0 effective as of 31 August 2026.
1. These Terms and Conditions set out the rules for using the Consulting.thestory.is website, in particular the rules for booking and providing paid and unpaid consultation services provided online.
2. The Service Provider is Story Design Sp. z o.o., with its registered office in Warsaw (00-105), address: ul. Twarda 18, entered in the register of entrepreneurs of the National Court Register (Krajowy Rejestr Sądowy) maintained by the 12th Commercial Division of the National Court Register under KRS number 0000465952, NIP 7010384365, REGON 146732514, share capital of PLN 5,060, e-mail address: biuro@thestory.pl, hereinafter referred to as “The Story” or the “Service Provider”.
3. Through the Website, The Story enables Clients to familiarise themselves with the Consultation offer, select a Consultation and an Expert, make a Booking and enter into an Agreement.
4. Consultations are conducted remotely, using means of distance communication, in particular tools enabling video conferencing.
5. The Terms and Conditions are made available to the Client free of charge before entering into the Agreement in a manner enabling their retrieval, reproduction and storage.
6. Acceptance of the Terms and Conditions is a prerequisite for making a Booking and entering into the Agreement.
For the purposes of the Terms and Conditions, the following terms shall have the following meanings:
1. Website - the website operating at Consulting.thestory.is, through which Consultations are presented and offered.
2. The Story / Service Provider - the entity indicated in § 1(2) of the Terms and Conditions.
3. Expert - a person indicated on the Website as the person conducting a given Consultation, possessing knowledge or professional experience in the subject area of that Consultation.
4. Client - a natural person, legal person or organisational unit making a Booking or using a Consultation.
5. Consumer - a natural person entering into a legal transaction with The Story that is not directly related to their business or professional activity.
6. Entrepreneur with consumer rights - a natural person entering into an Agreement directly related to their business activity, where the content of the Agreement indicates that it is not of a professional nature for that person, in cases where applicable law grants such person consumer rights.
7. Consultation - a paid or unpaid expert service provided online, consisting of a meeting between the Client and the Expert, the scope, expected duration, price and Expert of which are specified on the Website.
8. Consultation Description - information concerning a specific Consultation made available on the Website, specifying in particular its subject matter, scope, Expert, duration, price or unpaid nature, as well as any additional services.
9. Booking - the Client’s selection of a Consultation, Expert and available date, and provision of the data required to enter into and perform the Agreement.
10. Agreement - an agreement for the provision of a Consultation entered into remotely between the Client and The Story.
1. Through the Website, The Story provides the Client with free-of-charge services by electronic means, enabling in particular:
a) browsing the Consultation offer,
b) familiarising themselves with information about the Experts,
c) selecting a Consultation and an Expert,
d) selecting an available date,
e) making a Booking,
f) providing the data necessary to enter into and perform the Agreement, and using the payment process made available in the case of paid Consultations.
2. Use of the services referred to in section 1 does not require the creation of an account, unless expressly indicated otherwise on the Website.
3. The electronic service consisting in enabling the Client to make a Booking commences when the Client begins using the relevant functionality of the Website and ends when the Booking is made or when the Client terminates the process earlier.
4. The Client is obliged to use the Website in accordance with the law, good practices and the Terms and Conditions.
5. It is prohibited to provide unlawful content through the Website, as well as to undertake actions that may disrupt the proper functioning of the Website.
6. Complaints concerning services provided by electronic means may be submitted in accordance with § 13 of the Terms and Conditions.
1. The Consultation is an expert service provided on the basis of information provided by the Client and the knowledge and experience of the Expert.
2. The detailed subject matter of the Consultation, its scope, duration, price, the Expert, and any additional services are specified each time in the Consultation Description.
3. The Consultation Description constitutes an integral part of the Agreement.
4. In the event of any discrepancies between the Terms and Conditions and the Consultation Description, the provisions of the Consultation Description shall prevail with respect to the individual characteristics of the relevant service, in particular its subject matter, scope, duration, Expert, price and additional services. The Terms and Conditions govern the remaining rules for the provision of the service.
5. As part of the Consultation, the Expert may in particular:
a) analyse the problem presented by the Client,
b) ask questions aimed at clarifying the problem,
c) provide an assessment of the situation,
d) identify problems, risks or opportunities,
e) challenge the assumptions presented by the Client if, in the Expert’s opinion, this is necessary for a proper analysis of the problem,
f) indicate possible solutions,
g) provide recommendations or options for further action,
h) refer to materials provided by the Client, if the scope of the relevant Consultation so provides.
6. Unless the Consultation Description expressly provides otherwise, the subject matter of the Consultation does not include the preparation for the Client of a project, audit, source code, documentation, graphic design, written opinion or any other result constituting a separate work or product.
7. The Consultation is advisory in nature and does not constitute a guarantee of achieving any specific business, financial, marketing, technological or other result indicated or expected by the Client.
8. The Expert provides recommendations to the best of their knowledge, taking into account the information available at the time of the Consultation. The Client remains responsible for the decision to use the recommendations and for the manner in which they are implemented.
9. The recommendations may require further analysis, verification, testing or consideration of circumstances that were not known to the Expert during the Consultation.
10. Unless expressly stated otherwise in the Consultation Description, the Consultations do not constitute legal, tax, accounting, investment or other services requiring specific professional qualifications.
1. The Client makes a Booking by:
a) selecting the type of Consultation,
b) selecting an Expert, if several Experts are available for a given Consultation,
c) selecting an available date,
d) providing the required data,
e) accepting the Terms and Conditions,
f) in the case of a paid Consultation - making the payment.
2. The Client is obliged to provide true, current and complete data that enables the proper performance of the Agreement.
3. The Story may suspend the processing of a Booking if the data provided by the Client is incomplete, clearly untrue or prevents the Consultation from being provided.
In the case referred to in section 3, The Story shall, where possible, enable the Client to complete, correct or clarify the data before cancelling the Booking.
4. Before making a Booking, the Client shall receive at least the following information:
a) the subject matter and main characteristics of the Consultation,
b) the Expert,
c) the duration of the Consultation,
d) the price of the Consultation or information that it is provided free of charge,
e) available dates.
5. In the case of a paid Consultation, the button or other function used to place an order shall contain clear information indicating that making the Booking entails an obligation to pay.
6. In the case of a paid Consultation, the Agreement is concluded upon successful completion of the payment and receipt by the Client of a Booking confirmation sent to the e-mail address provided.
7. In the case of a free Consultation, the Agreement is concluded upon receipt by the Client of a Booking confirmation sent to the e-mail address provided.
8. The Booking confirmation may also contain a link enabling participation in the Consultation and organisational information concerning the meeting.
9. The Agreement is concluded for the period necessary to provide the specific Consultation.
1. The price of a paid Consultation is indicated on the Website before the Booking is made.
2. The price presented to a Consumer is a gross price and includes applicable taxes.
3. If the net price is displayed alongside the gross price, the gross price remains the total price presented to the Consumer.
4. The Client is obliged to make the payment using one of the payment methods made available on the Website.
5. Payment processing may be carried out by an external payment provider in accordance with the rules applicable to the relevant payment method.
6. Failure to successfully complete the payment means that the Booking of a paid Consultation has not been completed, unless expressly indicated otherwise on the Website. In accordance with the applicable laws, The Story shall issue an accounting document relating to the service provided.
1. The Story may offer selected Consultations free of charge.
2. The Terms and Conditions shall apply to free Consultations to the extent appropriate to the nature of such service.
3. Booking a free Consultation does not create an obligation for the Client to enter into any subsequent paid agreement with The Story.
4. The Story may specify additional conditions for the availability of a free Consultation in the Consultation Description, in particular those relating to the target group, subject matter, number of available dates or number of Consultations that may be booked by a single Client.
1. The Client should provide the Expert with the information necessary to conduct the Consultation in accordance with its subject matter.
2. If the Consultation Description provides for the possibility or requirement of providing materials in advance, the Client should provide them within a timeframe that allows the Expert to familiarise themselves with them.
3. The Client is responsible for the truthfulness, completeness and lawfulness of the information and materials provided.
4. The Client represents that they are authorised to provide The Story and the Expert with the materials made available in connection with the Consultation.
5. The Client should limit the provision of confidential information, personal data of third parties and other protected information to the scope actually necessary to conduct the Consultation.
6. If the nature of the Consultation requires the disclosure of confidential information, the Parties may agree on separate rules for its protection, including entering into a confidentiality agreement.
1. The Consultation shall take place on the date specified in the Booking confirmation.
2. The Client should join the meeting on time and have a device and internet connection enabling participation in the Consultation.
3. The Client’s late arrival does not automatically result in an extension of the Consultation.
4. In the event of technical problems on the part of The Story or the Expert that prevent the Consultation from being conducted, The Story shall offer the Client, as appropriate:
a) continuation of the meeting once the problem has been resolved,
b) a new date for the Consultation, or
c) in the case of a paid Consultation - a refund of the price of the Consultation if it is not possible to conduct it on another date or the Client does not accept the proposed date.
5. The Consultation may be recorded by The Story only after the participants have been informed in advance and consent has been obtained where required by applicable law.
6. The Client is not entitled to record, broadcast or share the course of the Consultation without the prior consent of The Story and the Expert.
1. The provisions of this section set out the rules for rescheduling or cancelling a booked Consultation and do not limit the statutory right of a Consumer to withdraw from the Agreement as set out in § 11.
2. The Client may reschedule or cancel the Consultation free of charge no later than 24 hours before the scheduled start of the Consultation, unless the Consultation Description provides for more favourable terms for the Client.
3. Rescheduling is subject to the Expert’s availability.
4. If a Client cancels a paid Consultation less than 24 hours before its scheduled start or fails to attend the Consultation, The Story may retain the fee for the Expert’s reserved time, subject to the mandatory rights of the Consumer, in particular the right to withdraw from the Agreement.
5. In the case of a free Consultation, failure by the Client to attend without prior cancellation of the Booking may constitute grounds for refusing to accept another Booking for the same free Consultation from that Client.
6. The Story may reschedule a Consultation for important reasons, in particular illness, an unforeseen event or the Expert’s unavailability. In such a case, the Client shall be given the option to select another available date.
7. The Story may cancel a Booking for a free Consultation without providing a reason.
8. If a paid Consultation cannot take place for reasons attributable to The Story and the Client does not accept a new date, The Story shall refund the Client the full price paid.
1. A Consumer and - in cases provided for by law - an Entrepreneur with consumer rights who has entered into an Agreement remotely may, as a general rule, withdraw from the Agreement without giving any reason within 14 days from the date of its conclusion.
2. To meet the deadline, it is sufficient to send the statement of withdrawal before the expiry of the deadline.
3. The statement of withdrawal may be sent in particular to the following e-mail address: reklamacja@thestory.pl.
4. The Consumer may use the model withdrawal form constituting Appendix No. 1 to the Terms and Conditions; however, this is not mandatory.
5. If the date of the Consultation falls before the expiry of the 14-day period for withdrawal from the Agreement, the commencement of the provision of the service before the expiry of this period shall take place at the Consumer’s express request, made in accordance with applicable law.
6. If, at the Consumer’s express request, the Consultation has commenced before the expiry of the withdrawal period, and the Consumer subsequently withdraws from the Agreement before the service has been fully performed, the Consumer shall be obliged to pay for the services provided up to the time of withdrawal, to the extent provided for by applicable law.
7. The right to withdraw from an Agreement for the provision of services shall not apply after the service has been fully performed by The Story, if the performance commenced with the prior and express consent of the Consumer, who, before the commencement of the performance, was informed that they would lose the right to withdraw from the Agreement once the service had been fully performed, and acknowledged this.
8. If the Consultation is to commence before the expiry of the withdrawal period, The Story may require the Consumer to submit a separate statement containing a request to commence the provision of the service before the expiry of this period and confirmation that the Consumer has acknowledged the consequences of the full performance of the service.
9. The provisions of this section do not limit the Consumer’s rights arising from mandatory provisions of law.
1. The following are required to use the Website and participate in a Consultation:
a) a device enabling access to the Internet,
b) an up-to-date web browser,
c) an active Internet connection,
d) an active e-mail address,
e) in the case of video conferencing – a device equipped with a microphone and, where necessary, a camera,
f) the ability to use the tool indicated in the Booking confirmation.
2. Use of the Internet may involve typical information and communication technology security risks. The Client should use up-to-date software and appropriate device security measures.
3. The Story shall take appropriate technical and organisational measures to ensure the proper and secure functioning of the Website, taking into account the nature of the services provided.
4. The Client should inform The Story of any identified irregularities in the functioning of the Website if they affect the ability to make a Booking or participate in a Consultation.
1. The Consumer may submit a complaint concerning the functioning of the Website, the Booking process, payments to the extent attributable to The Story, or the manner in which the Consultation was provided.
2. A complaint may be submitted:
a) electronically to: reklamacja@thestory.pl,
b) in writing to the address of The Story indicated in § 1(2).
3. A complaint should, where possible, contain:
a) information enabling identification of the Consumer,
b) an indication of the Consultation to which it relates, and a description of the objections raised,
d) the expected method of resolving the matter.
4. The absence of any of the above elements shall not result in the Consumer’s complaint being left unexamined if the subject matter of the complaint can be determined on the basis of the information provided.
5. The Story shall consider the Consumer’s complaint within 14 days from the date of its receipt.
6. The Story shall endeavour to consider complaints submitted by other Consumers also within 14 days.
7. The Consumer shall be informed of the manner in which their complaint has been considered using the contact details provided in the complaint or during the Booking.
1. The Story undertakes to provide Consultations with due care appropriate to the expert nature of the service.
2. The Consultation is conducted on the basis of the information available to the Expert at the time of its performance.
3. The Story shall not be liable for the consequences of:
a) the Client providing false, incomplete or outdated information,
b) the Client omitting material circumstances,
c) the use of recommendations in a manner inconsistent with their scope or context,
d) changes in circumstances occurring after the Consultation has been conducted,
e) independent business, organisational or technological decisions made by the Client on the basis of information obtained during the Consultation, unless The Story’s liability arises from mandatory provisions of law.
4. With respect to Clients who are neither Consumers nor Entrepreneurs with consumer rights, to the extent permitted by law:
a) The Story shall not be liable for the Client’s loss of profits,
b) The Story’s liability arising from a single Consultation shall be limited to the amount of the net fee paid for that Consultation.
5. The limitations of liability set out in section 4 shall not apply to the extent that the limitation of liability is prohibited under mandatory provisions of law.
1. The content of the Website, The Story’s materials, presentations, methods, models, frameworks, documents and other materials used or provided during the Consultation are subject to intellectual property rights held by The Story, the Expert or third parties.
2. The conclusion of the Agreement does not result in the transfer to the Client of economic copyrights or other intellectual property rights to such materials, unless the Parties expressly agree otherwise.
3. The Client may make notes from the Consultation for their own use and use the knowledge, conclusions and recommendations resulting from it for their own purposes or - in the case of a Client who is an entrepreneur - for the purposes of their business activity.
4. In particular, the protection of the intellectual property rights of The Story or the Expert does not limit the Client’s ability to use the recommendations obtained during the Consultation to make their own decisions and implement the solutions discussed.
5. Without the separate consent of The Story, the Client is not entitled to distribute for consideration, resell, publish or make available to third parties any materials provided by The Story or the Expert in a manner enabling them to be used as an independent product, training course, consultation or expert material.
6. The provisions of this section do not limit the Client’s rights to materials that were owned by the Client before being provided to The Story.
1. The Story shall treat information provided by the Client in connection with the Consultation as information intended for use for the purpose of performing the Agreement.
2. The Story shall not disclose to third parties the Client’s confidential information obtained in connection with the Consultation, except where:
a) this is necessary to perform the Agreement,
b) the obligation to disclose arises from applicable law,
c) the Client has consented to its disclosure,
d) the information was publicly available independently of any action by The Story.
3. If the Client intends to disclose during the Consultation information that is particularly significant from the perspective of their business, the Parties may enter into a separate confidentiality agreement prior to the Consultation.
4. The Story may use information relating to Consultations in anonymised and aggregated form for the purpose of developing its working methods and services, provided that this does not enable the Client to be identified or the Client’s confidential information to be disclosed.
1. Clients’ personal data is processed in accordance with applicable data protection regulations.
2. Detailed information concerning the data controller, the purposes and legal bases for data processing, data retention periods and the rights of data subjects is available in the Privacy Policy available on the Website.
3. Data may be transferred to entities providing The Story with services necessary for the provision of Consultations, in particular providers of booking, payment, e-mail and video conferencing systems, in accordance with the rules described in the Privacy Policy.
1. The Consumer may use out-of-court methods of handling complaints and pursuing claims in accordance with the principles set out in applicable law.
2. Information concerning the Consumer’s ability to use out-of-court methods of handling complaints and pursuing claims is available, among other places, on the websites of the Office of Competition and Consumer Protection and the relevant entities authorised to conduct proceedings for out-of-court consumer dispute resolution.
3. If a dispute is not resolved following a complaint submitted by the Consumer, The Story shall provide the Consumer with the information required by the provisions concerning out-of-court consumer dispute resolution.
1. In the case of a Client who is a legal person or an organisational unit, the person making the Booking represents that they are authorised to act on behalf of the Client or have been authorised by the Client to make the Booking.
2 If a Consultation is booked by an entrepreneur for its employee, associate, management board member or another person, the entrepreneur remains a party to the Agreement, unless expressly indicated otherwise during the Booking.
3. The provisions of the Terms and Conditions granting special rights to Consumers shall not apply to Clients who are entrepreneurs, except where a given right is available to an Entrepreneur with consumer rights pursuant to applicable law.
1. Agreements concluded on the basis of the Terms and Conditions shall be governed by Polish law, provided that the choice of Polish law does not deprive the Consumer of the protection afforded to them by mandatory provisions of law applicable to the Consumer, where such provisions apply.
2. Matters not regulated by the Terms and Conditions shall be governed by the relevant provisions of law.
3. In the case of Clients who are neither Consumers nor Entrepreneurs with consumer rights, any disputes arising from the Agreement shall be resolved by the court having territorial jurisdiction over the registered office of The Story.
4. In the case of Consumers, the jurisdiction of the court shall be determined by applicable law.
5. The Story may amend the Terms and Conditions, in particular in the event of changes in applicable law, the manner in which the Website operates, the scope of services provided or the Booking process.
6. An amendment to the Terms and Conditions shall not affect the terms and conditions of Agreements concluded before the amended version of the Terms and Conditions enters into force.
7. Consultations booked before the new version of the Terms and Conditions enters into force shall be governed by the version of the Terms and Conditions accepted by the Client when making the Booking.
8. The Terms and Conditions shall enter into force on 31 August 2026.
